The Longshore and Harbor Workers’ Compensation Act is a federal statute that provides strict liability to the employer for an injured longshore or harbor worker. A longshore or harbor worker is generally a shore-based maritime employee who engages in longshore and stevedore activities, ship repair, trailer repairs, but is not sailing with the vessel. And unlike a Jones Act seaman who has to prove negligence in order to recover, a longshore and harbor worker is guaranteed a recovery and medical expenses based on the degree of injury. But his recovery is limited by the federal schedules.
